Service Terms & Conditions

Thank you for choosing Vivatia Plants for your botanical services. Our goal is to create beautiful, thriving plant environments while maintaining clear expectations for both parties. By booking any service with Vivatia Plants, the client agrees to the following terms and conditions.


1. Nature of Living Plants

Plants are living organisms, and their health is influenced by many environmental factors beyond our control, including but not limited to:

• Lighting conditions
• Temperature fluctuations
• Humidity levels
• Air circulation
• Pest exposure
• Changes in watering routines
• Seasonal shifts
• Relocation of plants

Because of this, Vivatia Plants cannot guarantee the survival or long-term health of plants unless they are under ongoing maintenance care as outlined below.

2. Limited Plant Guarantee

Plant replacement guarantees are only offered for plants that have been under continuous professional maintenance by Vivatia Plants for a minimum of three (3) consecutive months.

Plants not maintained by Vivatia Plants during this period are not eligible for replacement guarantees.

Guarantees may be void if plant decline is caused by:

• Insufficient lighting or environmental conditions
• Client watering or plant care outside of scheduled service
• Relocation of plants by the client
• Pest infestations introduced from outside sources
• Damage caused by pets, children, or third parties
• Structural or environmental issues within the property

Replacement decisions are made at the discretion of Vivatia Plants after evaluating plant conditions.

3. Installations

Plant installations may include plant placement, planters, soil, decorative materials, and design services.

Clients are responsible for ensuring that all areas where plants will be installed are:

• Structurally stable
• Capable of supporting the weight of planters and soil
• Suitable for moisture exposure
• Providing appropriate light conditions for plant species

Vivatia Plants is not responsible for damage related to:

• Weight of planters on floors, shelves, or furniture
• Water seepage or moisture exposure over time
• Improperly installed shelves or furniture
• Structural instability of surfaces provided by the client

4. Repotting Services

Repotting is a stressful process for plants and may result in temporary decline, transplant shock, or plant loss.

By requesting repotting services, the client acknowledges:

• Repotting is performed at the client’s risk
• Some plants may not survive the repotting process
• Vivatia Plants does not provide replacement guarantees for repotted plants

The client assumes full responsibility for plant outcomes following repotting services.

5. Maintenance Services

Plant Maintenance Services may include watering, pruning, cleaning, pest inspection, fertilizing, and general plant care.

Maintenance visits are based on professional assessment of plant needs and environmental conditions.

If a client independently alters plant care between scheduled visits (watering, fertilizing, moving plants, etc.), Vivatia Plants cannot guarantee plant health outcomes.

Replacement guarantees for plants may only apply after three (3) months of uninterrupted maintenance service.

6. Pest Management

Plants may occasionally develop pests due to environmental conditions.

Vivatia Plants will notify clients if pest issues are observed and may recommend treatment options.

However, Vivatia Plants is not responsible for:

• Pest outbreaks originating from external plants brought into the space
• Pest infestations caused by environmental conditions outside our control
• Damage caused by pests before detection

Pest treatment may require additional services and fees.

7. Property Protection & Liability

While Vivatia Plants takes great care when working in client spaces, we are not responsible for damage to loose items, fragile decor, furniture, walls, flooring, or surrounding property during the performance of services.

Clients must remove or secure fragile or valuable items from service areas before our arrival.

Vivatia Plants is not liable for:

• Pre-existing damage to property
• Structural weaknesses in shelving, furniture, or walls
• Damage caused by water exposure from normal plant care
• Items stored or placed near plant installations

8. Environmental Conditions

Successful plant installations depend heavily on environmental conditions within the space.

Clients acknowledge that lighting conditions, HVAC systems, humidity, and temperature may affect plant performance.

If environmental conditions change after installation, plant health may decline, and replacement guarantees may not apply.

9. Consultations & Recommendations

Consultations include professional recommendations based on the information available at the time of the visit.

Plant success ultimately depends on environmental conditions and ongoing care. Recommendations provided during consultations do not constitute guarantees of plant survival.

10. Quotes & Project Estimates

Quotes provided by Vivatia Plants are general estimates based on the information available at the time of consultation. Final project costs may vary due to factors including, but not limited to:

• Plant availability
• Planter availability
• Shipping or delivery costs
• Material changes
• Site conditions discovered during installation
• Adjustments to project scope

Quotes are valid for 14 days unless otherwise specified.

A $50 estimate fee is required for detailed project estimates. This fee will be applied toward the final invoice if the project proceeds.

To formally schedule an installation date, a $1,000 project deposit is required. Installation dates are not reserved until the deposit has been received.

If the required deposit has not been submitted, the project will not be scheduled or placed on the calendar.

Deposits are applied toward the total project cost.

11. Access & Safety

Clients must provide safe and clear access to all service areas.

If workspaces are unsafe, obstructed, or inaccessible at the time of service, appointments may need to be rescheduled, and additional service fees may apply.

12. Plant Availability & Substitutions

Plant availability can vary depending on seasonal supply, grower inventory, and shipping conditions.

If specific plants included in a design proposal become unavailable, Vivatia Plants reserves the right to substitute plants with similar species, size, or aesthetic value that are suitable for the intended environment.

Any substitutions will be selected with the goal of maintaining the overall design integrity and plant health within the space.

If major substitutions are required, the client will be notified before installation whenever possible.

13. Watering, Drainage & Moisture

Indoor plants require regular watering and moisture management. While Vivatia Plants takes care to minimize water exposure, watering plants may occasionally result in minor water runoff or moisture around planters.

Clients are responsible for ensuring that surfaces where plants are placed are appropriate for plant care and water exposure.

Vivatia Plants is not responsible for:

• Water marks or moisture damage to floors, furniture, rugs, or surfaces
• Damage caused by improper drainage or decorative containers provided by the client
• Damage caused by client watering between scheduled maintenance visits
• Long-term moisture exposure from plant care

Protective trays or liners may be recommended when necessary, but cannot guarantee complete protection from moisture.

14. Client Interference with Plant Care

For plants under maintenance service, Vivatia Plants follows a professional care schedule based on plant species and environmental conditions.

If the client or third parties:

• Water plants between scheduled visits
• Move plants to different locations
• Repot, fertilize, or treat plants independently
• Introduce new plants into the environment

Vivatia Plants cannot guarantee plant health outcomes.

Plant guarantees may be void if plant care is altered or interfered with outside of scheduled maintenance services.

15. Photography & Portfolio Use

Vivatia Plants may photograph completed installations, plant arrangements, or serviced spaces for documentation, portfolio use, social media, website content, marketing materials, and educational content.

Photographs will focus primarily on plants, design work, and botanical installations.

Vivatia Plants will make reasonable efforts to avoid capturing personal items, identifying details, or private areas of the client's space whenever possible.

If a client prefers that their space not be photographed or shared publicly, they must notify Vivatia Plants in writing before the service or installation date.

16. Acceptance of Terms

By booking any service with Vivatia Plants, the client confirms that they have read, understood, and agreed to these Terms & Conditions.
